    Presentation Overview:

    OFLA has been amended to harmonize with Paid Leave Oregon, to a certain extent, after Senate Bill 999 was passed in the 2023 Oregon legislative assembly. As of June 5, 2023, we are waiting for the Governor to sign it into law, if she does. In this 2-hour in-person training, we will cover the changes.

    Description of the content:

    • The new definitions of serious health condition, family member, and leave year
    • Employee eligibility requirements for FMLA, OFLA, and Paid Leave
    • Nine qualifying events
    • Duration of leave
    • Intermittent leave
    • Use of accrued time
    • Effects on Pay and benefits
    • Reinstatement
    • Extended leave

    Learning objective: The participants will learn how to track and stack FMLA, OFLA and Paid Leave.

    Presenter:

    Joseph Tam is a Training and Development Specialist with the Employer Assistance and a
    former Senior Civil Rights Investigator with the Civil Rights Division of the Oregon Bureau of Labor and Industries. He has been working for the agency for about 39 years. He is a graduate of Ricks College, Rexburg, Idaho, and Portland State University. He conducts in-person seminars and webinars on Oregon Family Leave Act (OFLA), the federal Family and Medical Leave Act (FMLA), Family and Medical Leave Insurance (aka Paid Leave Oregon), Oregon Sick Time Law, Leave Law Basics, Advanced Leave Laws, Leave Laws in Oregon – 2-day training, Workplace Accommodations Issues, Workplace Harassment and Discrimination, Wage and Hour Laws, Payroll Issues, Effective Supervisory Practices, Legal Hiring Practices, Documentation, Discipline, and Discharge, Dealing with Difficult Employees, Injured Workers Laws, Life of a Workers’ Compensation Claim, Disability Laws, Drug and Alcohol Issues in the Workplace, etc. throughout Oregon. He is known to make the Recordkeeping seminar “interesting.” He regularly presented at BOLI’s Annual Employment Law Conference. In the 2022 conference, he presented “How to track OFLA, FMLA, and Paid Leave Oregon in 2023.” An Oregon employment law attorney wrote, “I watched your video yesterday from the Annual Conference and found your presentation on OFMLI/OFLA/FMLA imminently helpful and entertaining!”

    This will be an in-person meeting. Lunch will be provided.
